Can a motorist sue the person who rear ended them 1 yr after the accident?
What if the person who was rear ended did not file a personal injury to the insurance company at the time of the accident? Can he still out of the blue file a lawsuit against the person who hit him even though it had been over a year, claiming that he was seriously injured? What are the chances of this person winning the lawsuit?

I scraped my dad’s car against a gaurdrail on a sharp turn last night. My parent’s are in Hawaii right now (eek!) Do I file a claim with my insurance company or do they file it with their insurance? I lost my home can due to injuries I received in rollover car accident. How can I get it back?
I was a passenger in a car accident in November. I sustained injuries that have prevented me from working. I filed a claim with work mans comp insurer and they disputed it. During this time my home went into foreclosure and was sold on feb 20 after I made arrangements with my lender to save my home. Two weeks ago the insurer accepted liability and is paying a settlement. Is there a way to keep my ?

Car accident Claim not my fault what to expect or what to do?Help?
I was in a car accident 5 days ago with my children. The person was on the cell phone when I got hit and according to a witness the person blew the stop sign. The person ended up hitting me on the driver side of my car and since we were in opposite directions the other car got hit on the driver side as well. We both hit each other but the other car was all over my lane and when I realized this person wasn’t going to move into their lane I braked but it wasn’t fast enough and we both hit. To my understanding the person who collided with me got the ticket for being on the cell phone, not sure if received a ticket for blowing the stop sign. We were taken to the hospital in an ambulance and were release the same day with minor injuries (bumps, bruises and I got stitches in my mouth). I took the minimum days of work three days and can’t afford to take more time because I recently began this new job and have a mortgage. I made the claim with their insurance since it wasn’t my fault and I gave a statement. I was told by the claim department they would contact me. I called the claim on thursday since I hadn’t heard from them and they told me they haven’t gotten in contact with the other party. This is my first accident and I don’t know what to do? My car is and older car, but was in great functioning condition for my job. I depend on a car for my job everyday and since I only have liability my insurance doesn’t cover me. Please does any one have any advice. I am nervous because I haven’t heard from them or they haven’t made a claim against me.

What do you think is the expected amount to receive from a settlement from a car accident?
I was recently in a car accident and I sued the person because I was hit in the back and my car was totaled. I went to physical thearpy for a few weeks and I went to the doctor every weekend. I was not a fault in the accident. My lawyer is settling my case within the next four to six weeks and I would like to know a good settlement amount that I should recieve after medical bills and the lawyers fee. How long does it usually take to recieve another offer if you decline the first offer? The claim was submitted to Geico and I heard they are pretty fast. Just

Weather related accident - Should I file a claim?
My husband slid off the road and hit a tree. There is moderate damage to the passenger side of the car, but the car is still driveable. The car is worth 6K. I think the door, rear fender, and window will need to be replaced. Is it worth filing a claim? Could we file a no fault claim?
We are either going to get the car fixed (if the damage is not too much) or buy a new car.
Any advice is welcome!

Auto accident Claim 2 times?
I was involved an auto accident at no my fault, we exchanged our insurance details, I filed a claim at ABC company (the other party) also I reported to my company (XYZ). ABC Company came with as this accident is happened at parking lot they will pay only 50% after the investigation, I said OK to them then in a day appraiser inspected my vehicle. ( First I thought I can fix this dent as it looks minor to me), my try was failed so I changed my mind in next day and went thru My XYZ Company as I had 100% coverage on my car.
After inspection of ABC Company they sent check for 50% and now my XYZ is going to pay for the damages to the collision shop.
Is it OK to deposit the check form ABC to bank account? Will I be trouble in later?

Chiro didnt submit bills to healthnet after my car accident now wants me to pay him 100% of bill from settlmnt
After my car accident my chiropractor did not submit any claims for reimbursement from Healthnet which is my insurance. They would only pay him 40 cents on the dollar.
Now that I have a small settlement, he wants me to pay him 100% of the bills that he never sent to Healthnet. Is this legal?

If you’re at fault for the accident but the person you hit has expired insurance?
Here is the story:
My fiance drives a truck and a couple of months ago he rear-ended a girl in a honda accord. Nothing serious, but her car was slightly damaged. When the police arrived to make a report, my fiance was issued a ticket for the accident and the girl was also issued a ticket because her car insurance had expired.
Later that day he contacts his agent and they tell him that if she was driving without any coverage at the time of the accident, any claim she files with his insurance co. will be denied. They retrieved a police report to confirm. He was also told not to worry about the matter any further.
He gets a call today informing him that she did file a claim, he/his insurance company will have to pay and on top of that she is filing personal injury and wants to sue.
Were we just misinformed? She shouldn’t even have been on the road in the first place if she didnt have any insurance. Is there anything we can do regarding this? We live in Louisiana. Thanks for your help
I understand he was at fault and of course has to pay for damages now but I don’t understand why his insurance company would tell him they would deny her claim and not pay because hers was expired

Auto accident claim - what should I tell my insurance company?
I was on a small lane waiting for all traffic to clear before backing up into a parking spot.
There was a car signaling to turn onto the street I was on.
I waited for the driver to turn, but she did not move so I started reversing.
The driver of the other car, instead of turning, drove straight behind my car and I backed into it.
Her door had a dent, and my bumper was scratched.
We exchanged info but did not make a police report (did not know better).
There were no passengers or witnesses.
We also did not take any pictures of the accident.
I noticed that apart from the door, her car was not in good shape - it had several dents and the bumper was loose.
I tried to follow up with her, but did not hear back.
Only now, 2 months later, does my insurance company call and says that her company is making a claim, and that they need details.
How much I should say to my insurance company - are they on my side?
What would be the best course of action?
I’m at a loss right now….
